2. Nature of business

Trapsuutjie Linen (Pty) Ltd designs and supplies garments manufactured from natural linen, sold directly to consumers through this website. Garments are manufactured to order.

4. Tax status

Trapsuutjie Linen (Pty) Ltd is not registered as a vendor in terms of the Value-Added Tax Act 89 of 1991. Prices are not subject to value-added tax and no tax invoice is issued in respect of any sale.

5. Website and payment infrastructure

5.1 This website is hosted on the Shopify platform, operated by Shopify Inc.

5.2 Payment is processed by third-party payment providers. Trapsuutjie Linen (Pty) Ltd does not receive, process or store complete payment card details. Payment card information is transmitted directly to the relevant payment provider over an encrypted connection.

6. Terms governing the sale of goods

6.1 The following documents are published on this website and govern access to it and every contract of sale concluded through it:

(a) the Terms and Conditions of Sale and Website Use;

(b) the Returns and Exchanges Policy;

(c) the Shipping and Delivery Policy;

(d) the Privacy Policy;

(e) the published size guide.

6.2 Each of the above documents may be accessed, downloaded and retained in electronic form at any time before the conclusion of a transaction.

6.3 The manner in which orders are placed, the point at which a contract of sale comes into existence, the correction of input errors and the currency and composition of the price are set out in the Terms and Conditions of Sale and Website Use.

7. Cooling-off rights

7.1 Section 44 of the Electronic Communications and Transactions Act 25 of 2002 confers upon a consumer who concludes an electronic transaction the right to cancel without reason and without penalty within 7 (seven) days of receipt of the goods.

7.2 That right does not apply to goods made to the consumer's specifications, to goods that by reason of their nature cannot be returned, or in the other circumstances contemplated in section 42(2) of that Act.

7.3 The application of these provisions to garments supplied by Trapsuutjie Linen (Pty) Ltd, which are manufactured to order, is set out in the Returns and Exchanges Policy.

7.4 The rights conferred by the Consumer Protection Act 68 of 2008, including the right in terms of section 56 to return goods that fail to satisfy the requirements of section 55 within 6 (six) months of delivery, are unaffected.

8. Protection of personal information

8.1 Trapsuutjie Linen (Pty) Ltd is the responsible party in respect of personal information processed through this website, as contemplated in the Protection of Personal Information Act 4 of 2013.

8.3 The manner in which personal information is collected, processed, disclosed, secured and retained, and the rights of data subjects, are set out in the Privacy Policy.

9. Intellectual property

The name "Trapsuutjie", the Trapsuutjie wordmark and device, the names of the Trapsuutjie colourways, and all text, photography, graphics and garment designs appearing on this website are the property of Trapsuutjie Linen (Pty) Ltd or its licensors, and are protected in terms of the Copyright Act 98 of 1978, the Trade Marks Act 194 of 1993, the Designs Act 195 of 1993 and applicable foreign law. All rights are reserved.

10. Complaints and dispute resolution

10.1 Complaints must be directed in writing to the electronic address in clause 3.1. Receipt is acknowledged within 5 (five) business days.

10.2 Trapsuutjie Linen (Pty) Ltd does not subscribe to any alternative dispute resolution code or accredited industry code as contemplated in section 82 of the Consumer Protection Act 68 of 2008.

10.3 A consumer whose complaint is not resolved may refer the matter to:

11. Governing law

The law of the Republic of South Africa governs this website, its content and every contract of sale concluded through it.
